Letter to Legislators from Judith Brumbaugh
Dear Legislator,
Thirty million marriages have ended in divorce--what an astonishingly sad statistic! This number doesn't even come close to providing an accurate reflection of the splintering of the American family that has occurred as a result of our nation's No-fault Divorce laws. Millions have suffered and continue to suffer emotional heartache and financial hardship in the wake of the many unexpected, frequently unreported, and egregious abuses of justice in our nation's courtrooms. Many defendant spouses, compelled into court against their will, have been denied equal representation and deprived of equal and impartial justice.
No-fault was designed to avoid the assigning of fault in a divorce action with the hope that bitterness and hostility between the parties would be reduced, perjury would be curtailed, and there would be an honoring of the law and its processes during the No-fault divorce proceedings. But sadly, that is not what has happened.
Attorney J. Shelby Sharpe is an endorser of the enclosed book, Judge, Please Don’t Strike That Gavel. . . On My Marriage. As a lawyer with more than 40 years of litigation experience involving federal and state constitutional issues, he has written: "No-fault Divorce is the most devastating event that has ever occurred in American history by any measurement. This book describes those consequences and explains why all No-fault Divorce laws should be repealed." Attorney Sharpe further states, "No-fault Divorce is the only claim recognized in the state courts of the United States where the due process clause for protecting a fundamental right (which marriage has been found to be by the United States Supreme Court) is ignored and patently disregarded."
